Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pictograph's website, application, API, SDK, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
Accounts and eligibility
You must be able to form a binding contract to use the Service. You are responsible for the activity under your account, for keeping your credentials and API keys secure, and for ensuring your team members comply with these Terms. You must provide accurate account information.
Acceptable use
You agree not to:
- Upload content you do not have the rights to use, or that is unlawful, infringing, or harmful.
- Attempt to access another organization's data, probe security controls, or bypass rate limits and quotas.
- Use the Service to build unlawful surveillance systems or to violate the privacy or rights of others.
- Resell or sublicense the Service except as expressly permitted.
- Disrupt or degrade the Service or its infrastructure.
Compute credits, plans, and billing
Paid features such as auto-annotation, model training, image generation, deployments, and workflows consume compute credits, a balance denominated in US dollars. Each plan includes a monthly compute allowance equal to its price. Manual annotation is always free.
- Your monthly allowance renews at the start of each billing period and does not roll over.
- By default, paid operations pause when you reach your allowance. On paid plans you may enable pay-as-you-go with a monthly Budget cap: usage beyond your allowance bills to your card up to that cap, and never more.
- Subscriptions renew automatically until cancelled. You can change plans at any time, with changes effective immediately and billing prorated.
- Fees are non-refundable except where required by law. Payments are processed by Stripe.
Your content and intellectual property
You own the images, annotations, datasets, and models you create or upload. You grant Pictograph a limited license to store and process that content solely to provide the Service to you. We do not use your content to train shared or foundation models. Pictograph and its software, branding, and documentation remain our property.
If you publish a dataset or model to the public Explore hub, you grant other users the ability to view and fork it under the license you select. You are responsible for having the rights to publish that content.
Service availability
We work to keep the Service available and performant, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features, and we will give reasonable notice of material changes where practical.
Warranty disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Machine-generated annotations, models, and predictions may contain errors and should be reviewed before use in production.
Limitation of liability
To the maximum extent permitted by law, Pictograph will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months before the claim.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to the platform. On termination, your right to use the Service ends; you may export your content before deletion.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where appropriate, communicated to you. Continued use of the Service after changes take effect constitutes acceptance.
